Welcome

Welcome to Hidden Gems AS. Our goal is to provide authentic, personal and unforgettable outdoor experiences throughout Norway. Unlike traditional sightseeing tours, our experiences focus on small groups, flexibility and discovering places beyond the typical tourist routes.

||Nature is at the heart of everything we do. While every tour is carefully planned and professionally guided, outdoor activities always involve a level of risk that cannot be completely eliminated.

||These Terms & Conditions explain how our services operate, what you can expect from Hidden Gems AS, and what we expect from our guests. They are designed to create a safe, enjoyable and transparent experience for everyone.

||By requesting a booking, confirming a booking or participating in any service provided by Hidden Gems AS, you acknowledge that you have read, understood and accepted these Terms & Conditions together with any additional policies referenced within them.

Definitions

Throughout these Terms & Conditions the following definitions apply.

CompanyHidden Gems AS.
GuideAny guide, employee, contractor or authorised representative acting on behalf of Hidden Gems AS.
Guest / ParticipantAny individual participating in a tour, activity, transport service or any other service provided by Hidden Gems AS.
BookingA reservation confirmed in writing by Hidden Gems AS following direct communication via email, telephone, video meeting or another approved communication channel. Submitting a contact form through the website does not constitute a confirmed booking.
ServicesAny activity organised by Hidden Gems AS including but not limited to: guided hiking tours, private hiking tours, scenic road trips, photography experiences, holiday planning, custom itineraries, nature experiences, transportation related to booked experiences, and any additional services agreed in writing.
Natural EnvironmentIncludes mountains, forests, waterfalls, rivers, fjords, lakes, coastlines, trails, gravel roads and any other outdoor environments visited during our experiences.

Company Information

Hidden Gems AS is a Norwegian registered company operating under Norwegian law. The Company provides guided outdoor experiences, customised travel planning and related tourism services.

||All agreements entered into with Hidden Gems AS shall be governed exclusively by Norwegian law unless mandatory legislation requires otherwise.

||The Company reserves the right to update these Terms & Conditions at any time. The version applicable to a booking is the version accepted by the Guest at the time the booking is confirmed.

Booking Process

Hidden Gems AS specialises in personalised experiences. For this reason, bookings are not completed automatically through the website.

||The booking process consists of the following steps:

1. The Guest contacts Hidden Gems AS through the website, email or another approved communication method.
2. Hidden Gems AS discusses the Guest's wishes, expectations, fitness level, travel dates and any special requirements.
3. Hidden Gems AS prepares a customised itinerary and quotation.
4. Any adjustments are discussed until both parties agree upon the proposed experience.
5. Hidden Gems AS sends a written booking confirmation together with payment instructions.
6. The booking becomes legally binding only after written confirmation has been received, and the Booking Confirmation Fee has been paid within the agreed deadline.

||Until these conditions have been fulfilled, Hidden Gems AS reserves the right to offer the requested dates to other guests.

Booking Confirmation Fee

To reserve dates exclusively for a Guest, Hidden Gems AS requires a 30% Booking Confirmation Fee. This fee secures the agreed dates and compensates the Company for reserving availability that cannot reasonably be sold to another customer.

||Because Hidden Gems AS primarily provides private and customised experiences with limited availability, significant preparation begins immediately after confirmation. This may include itinerary planning, route planning, reservations, communication with suppliers, scheduling, administrative work, and allocating exclusive dates that cannot be offered to other guests.

||The Booking Confirmation Fee is applied first towards administrative work, planning time, itinerary preparation and the reservation of exclusive dates. Where cancellation occurs, any retained amount shall not exceed Hidden Gems AS's documented financial loss, except where the parties have agreed otherwise and such agreement is permitted under mandatory Norwegian law.

||Failure to pay the Booking Confirmation Fee within the specified deadline may result in automatic cancellation of the proposed booking.

Final Payment

Unless otherwise agreed in writing, the remaining balance must be paid no later than 30 days before the first scheduled service.

||If a booking is made less than 30 days before arrival, Hidden Gems AS may require full payment immediately upon confirmation.

||Failure to complete payment by the due date may result in cancellation of the booking. Where possible, Hidden Gems AS will first attempt to contact the Guest before cancelling the reservation.

Prices

All quotations provided by Hidden Gems AS are valid only for the period specified in the quotation.

||Prices may change if: the Guest changes the itinerary; the duration changes; the group size changes; transportation requirements change; accommodation changes; entrance fees change; ferry, toll or parking costs change; or government taxes or mandatory charges change.

||Any such adjustments will be communicated before the booking is finalised whenever reasonably possible.

Right of Withdrawal

Under the Norwegian Right of Withdrawal Act (angrerettloven), the statutory 14-day right of withdrawal does not apply to contracts for leisure services where the Company agrees to provide the service on a specific date or during a specific period. Hidden Gems AS provides date-specific outdoor and travel experiences, and such bookings are therefore exempt from the statutory 14-day cancellation right.

||The cancellation terms set out in these Terms & Conditions apply instead. This does not affect any mandatory rights the Guest may have under Norwegian law.

Customer Cancellations

Hidden Gems AS dedicates significant time and resources to planning each experience. Most tours are private and exclusively reserved for a single guest or group. As a result, cancellations may prevent the Company from accepting other bookings for the same dates.

||For this reason, the following cancellation policy applies unless otherwise agreed in writing.

8.1 Booking Confirmation Fee

The 30% Booking Confirmation Fee is charged to reserve the agreed dates and begin planning the experience. It is applied first towards administrative work, planning time, itinerary preparation and the reservation of exclusive dates. Where cancellation occurs, any retained amount shall not exceed Hidden Gems AS's documented financial loss, except where the parties have agreed otherwise and such agreement is permitted under mandatory Norwegian law.

8.2 Cancellation by the Guest

If the Guest cancels more than 30 days before the scheduled start date: the remaining balance will not be charged if it has not yet been paid, and the Booking Confirmation Fee remains non-refundable as set out above.

||If the Guest cancels 30 days or less before arrival: the Guest may be liable for the agreed tour price, reduced by any costs the Company saves and by any amount the Company reasonably recovers by re-selling the reserved dates. Hidden Gems AS may, at its discretion, offer an alternative solution such as rescheduling. This reflects the Company's actual documented loss and is applied in accordance with mandatory Norwegian consumer law. Hidden Gems AS will take reasonable steps to mitigate its losses where practical.

8.3 Rescheduling

Hidden Gems AS understands that unexpected situations may occur. Where operationally possible, the Company may offer to reschedule the experience instead of treating the booking as cancelled. Rescheduling is entirely subject to availability and is not guaranteed.

Changes Requested by the Guest

Hidden Gems AS specialises in tailor-made experiences. Reasonable changes requested before the experience begins will normally be accommodated whenever possible.

||Examples include pickup location, hiking difficulty, duration, group size, photography options, and transport arrangements.

||If the requested changes significantly affect costs, logistics or availability, Hidden Gems AS reserves the right to adjust the quoted price accordingly. Major itinerary changes requested shortly before departure may not always be possible.

Changes Made by Hidden Gems AS

The safety and quality of each experience take priority over following the original itinerary exactly. Hidden Gems AS therefore reserves the right to modify any aspect of the planned experience whenever reasonably necessary.

||This may include, but is not limited to: changing hiking routes; changing viewpoints; altering the order of activities; changing pickup times; shortening or extending activities where appropriate; replacing destinations with comparable alternatives; and modifying transportation arrangements.

||Whenever possible, Guests will be informed in advance. Reasonable modifications made in the interest of safety or operational necessity do not constitute a breach of contract.

Weather Policy

Norwegian weather is highly unpredictable. Hidden Gems AS plans all experiences with safety as the highest priority. Weather conditions may change rapidly and may affect access to mountains, waterfalls, ferries, roads and hiking trails.

||Weather conditions in Norway may change rapidly within minutes. Decisions made by the Guide concerning weather, route selection or cancellation are based on professional judgement and are final for safety reasons.

||The Company reserves the right to: change destinations; modify routes; shorten hikes; delay departure; cancel activities; or replace outdoor activities with alternative experiences. These decisions are made solely by Hidden Gems AS based on professional judgement.

||Guests acknowledge that weather-related changes form a normal part of outdoor tourism in Norway. Weather conditions alone do not automatically entitle the Guest to refunds.

||If Hidden Gems AS must cancel an experience entirely due to unsafe conditions and no suitable alternative can reasonably be provided, the Company will offer either an alternative date, an alternative activity, or an appropriate refund, depending on the circumstances.

Participant Requirements

Guests are responsible for ensuring that they are physically capable of participating in the booked activity.

||Before confirming a booking, Guests should carefully consider physical fitness, hiking experience, existing injuries, medical conditions, mobility limitations, and fear of heights where relevant.

||Hidden Gems AS relies on information provided by Guests when recommending suitable experiences. Providing inaccurate or incomplete information may reduce the Company's ability to provide an appropriate experience.

Health & Medical Conditions

Guests must inform Hidden Gems AS before arrival if they have any medical condition that could reasonably affect their participation or require assistance.

||Examples include heart conditions, respiratory illnesses, severe allergies, diabetes, epilepsy, pregnancy, recent surgery, mobility limitations, or any other condition that may affect safety.

||Hidden Gems AS treats such information confidentially in accordance with applicable privacy legislation and only uses it to plan a safe experience. Please also see the Data Protection & Privacy section below.

||The Company reserves the right to recommend an alternative activity or refuse participation where a medical condition creates an unreasonable safety risk.

Equipment

Guests are responsible for arriving with suitable clothing and equipment appropriate for Norwegian outdoor conditions.

||Unless otherwise agreed, this includes proper hiking footwear, weather-appropriate clothing, waterproof outerwear, warm layers, drinking water, food, required medication, sunscreen, and sunglasses where appropriate.

||Hidden Gems AS may refuse participation where inadequate equipment presents a significant safety risk. No refund will normally be provided where participation is refused due to clearly unsuitable clothing or equipment that was communicated in advance.

Safety

Safety is the Company's highest priority. Hidden Gems AS takes reasonable measures to minimise foreseeable risks through careful planning, weather monitoring, route assessment, local knowledge, and ongoing risk evaluation.

||However, nature cannot be controlled. Participants understand that outdoor activities involve inherent risks including, but not limited to: slips; trips; falls; wet rocks; uneven terrain; steep slopes; changing weather; rivers; wildlife; insects; falling branches; loose stones; and other natural hazards.

||By participating, Guests acknowledge these inherent risks. Participants remain individually responsible for where they place their feet, maintaining their own balance, moving safely through the terrain, and following instructions given by the guide.

||Hidden Gems AS cannot guarantee a risk-free environment.

Transportation

Where transportation is included as part of a booked experience, Hidden Gems AS will provide transport as specified in the booking confirmation. Transportation may include pickup and drop-off at agreed locations, transport between activity locations, or other travel directly related to the booked experience.

||Hidden Gems AS reserves the right to modify pickup times, routes or vehicles where reasonably necessary due to traffic, road conditions, weather, ferry schedules, safety considerations or other operational circumstances.

||Guests are responsible for arriving at the agreed pickup location on time. If a Guest fails to arrive within 15 minutes of the agreed pickup time without prior communication, Hidden Gems AS reserves the right to continue the tour without the Guest. Such situations may be treated as a no-show.

||Guests must follow all safety instructions while travelling, including the use of seat belts where required by Norwegian law.

Photography & Media

Photography services are available as an optional add-on unless otherwise agreed in writing.

||Hidden Gems AS may take photographs or videos during tours for documentation and marketing purposes. No photographs or videos clearly identifying individual Guests will be used for advertising, promotional material, social media or the Company's website without the Guest's explicit consent.

||Guests may choose whether or not they wish to appear in promotional content. Refusing consent will not affect the Guest's experience or booking in any way.

||Where photography services have been purchased, delivery times, editing style and image quantities will be agreed separately. All photographs remain the intellectual property of Hidden Gems AS unless otherwise agreed in writing. Guests receive a personal licence for private use of purchased images. Commercial use, resale or redistribution requires prior written permission from Hidden Gems AS.

Children

Guests under the age of 18 may only participate with the consent of a parent or legal guardian.

||Parents or legal guardians remain fully responsible for supervising minors throughout the experience unless otherwise agreed in writing.

||Hidden Gems AS reserves the right to recommend alternative activities where a planned experience is not considered suitable for younger participants.

Environmental Responsibility

Hidden Gems AS is committed to protecting Norwegian nature. All Guests are expected to follow the principles of Leave No Trace and show respect for the environment, wildlife and local communities.

||Participants agree to: leave nature exactly as they found it; dispose of all waste responsibly; avoid damaging vegetation; remain on established paths where instructed; respect wildlife and livestock; avoid unnecessary disturbance to other visitors; and comply with local regulations and protected area rules.

||Any deliberate damage to nature or property caused by a Guest may result in immediate termination of the experience without refund. Guests may also be held personally responsible for any damage they cause.

Guest Conduct

Hidden Gems AS aims to provide a safe, enjoyable and respectful environment for all participants. Guests are expected to behave responsibly throughout the experience.

||Hidden Gems AS reserves the right to refuse participation or remove any Guest whose behaviour may endanger themselves, other participants or the guide; damage equipment or property; negatively affect the experience of others; or violate Norwegian law.

||Examples include aggressive behaviour, harassment, discrimination, intoxication, drug use, reckless conduct, and refusal to follow safety instructions.

||Removal from an activity due to misconduct does not entitle the Guest to any refund.

Liability

Hidden Gems AS is responsible for exercising reasonable care and professional judgement in planning and conducting its services. The Company takes reasonable steps to minimise foreseeable risks. However, outdoor activities involve inherent risks that cannot be completely eliminated.

||Guests acknowledge that participation is voluntary and that they accept the normal risks associated with hiking, sightseeing and outdoor recreation.

||To the fullest extent permitted under Norwegian law, Hidden Gems AS shall not be liable for losses, injuries or damages arising from: a Guest's failure to follow instructions; unsuitable clothing or equipment; undisclosed medical conditions; reckless or negligent behaviour by a Guest; natural hazards that could not reasonably have been prevented; actions taken by third parties; delays caused by weather, road closures, ferries or other external factors; or force majeure events.

||Nothing in these Terms excludes or limits liability for death or personal injury caused by the Company's negligence, or any other liability that cannot be excluded under mandatory Norwegian law.

Insurance

Guests are strongly encouraged to obtain comprehensive travel insurance before travelling to Norway.

||Insurance should include, where applicable: medical treatment; emergency evacuation; cancellation; personal belongings; and hiking and outdoor activities.

||Hidden Gems AS is not responsible for insurance arrangements made by Guests.

Force Majeure

Hidden Gems AS shall not be liable for failure or delay in performing its obligations where such failure results from circumstances beyond its reasonable control.

||These may include, but are not limited to: extreme weather; flooding; landslides; avalanches; wildfires; pandemics; government restrictions; strikes; ferry cancellations; road closures; natural disasters; acts of terrorism; civil unrest; power failures; and other extraordinary events.

||Where possible, Hidden Gems AS will attempt to offer an alternative solution.

Data Protection & Privacy

Hidden Gems AS processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Norwegian Personal Data Act (personopplysningsloven).

||The Company collects and processes personal data such as name, contact details, booking information and, where relevant, health or medical information provided voluntarily by the Guest. Health-related information is treated as a special category of personal data and is processed only with the Guest's explicit consent, solely for the purpose of planning and delivering a safe experience.

||Personal data is stored securely, retained only as long as necessary, and never sold to third parties. Guests have the right to access, correct, or request deletion of their personal data, and to withdraw consent at any time. Full details are set out in the Company's Privacy Policy.

Complaints

If a Guest is dissatisfied with any aspect of an experience, Hidden Gems AS requests that concerns be raised with the guide as soon as reasonably possible. Many issues can be resolved immediately during the experience.

||Formal complaints should be submitted in writing within 14 days after the completion of the service. Hidden Gems AS will investigate all complaints fairly and respond within a reasonable time.

Intellectual Property

All content created, published or provided by Hidden Gems AS, including but not limited to photographs, videos, drone footage, itineraries, route descriptions, maps, logos, branding, written materials, website content and marketing materials, remains the exclusive intellectual property of Hidden Gems AS unless otherwise agreed in writing.

||Guests may not reproduce, distribute, modify, publish or use such material for commercial purposes without prior written permission. Purchased photographs are licensed for personal, non-commercial use only unless a separate commercial licence has been agreed.

Third-Party Services

Certain services provided during an experience may involve third-party suppliers, including but not limited to accommodation providers, restaurants, cafés, ferry operators, museums, activity providers or transportation services.

||Hidden Gems AS carefully selects its partners but cannot accept responsibility for services provided independently by third parties. Any delays, cancellations, operational changes or service failures caused by third-party providers remain subject to the terms and conditions of those providers.

||Hidden Gems AS will make reasonable efforts to assist Guests in finding suitable alternatives whenever practical.

Lost Property

Guests remain solely responsible for their personal belongings throughout the experience.

||Hidden Gems AS accepts no responsibility for loss, theft or damage to personal property including, but not limited to: cameras, mobile phones, drones, clothing, luggage, jewellery, wallets, passports, and personal equipment.

||If personal belongings are found after a tour, Hidden Gems AS will make reasonable efforts to contact the Guest. Any shipping or delivery costs shall be borne by the Guest.

Website Disclaimer

Hidden Gems AS makes every reasonable effort to ensure that all information published on its website is accurate and up to date.

||However, website content, including itineraries, activity descriptions, photographs, travel times, prices and availability, is provided for general information purposes only and may change without prior notice.

||Nothing published on the website shall be interpreted as a legally binding offer unless confirmed in writing by Hidden Gems AS.

Electronic Communication

Guests agree that communication conducted through email, written messaging services or other electronic communication methods approved by Hidden Gems AS shall constitute valid written communication.

||Booking confirmations, invoices, amendments and other contractual information may be delivered electronically. It is the Guest's responsibility to ensure that contact details provided are accurate and monitored regularly.

Severability

If any provision of these Terms & Conditions is found by a competent court or authority to be invalid, unlawful or unenforceable, such provision shall be deemed severed only to the extent necessary.

||The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms & Conditions, together with the Booking Confirmation, Privacy Policy, Safety & Participant Responsibility Policy and any written agreements between the Parties, constitute the complete agreement between Hidden Gems AS and the Guest.

||No verbal statements or representations shall modify these Terms unless confirmed in writing by Hidden Gems AS.

Amendments

Hidden Gems AS reserves the right to update these Terms & Conditions at any time.

||Any changes shall apply only to bookings confirmed after the revised version has been published unless otherwise required by mandatory law. The version accepted by the Guest at the time of booking shall remain applicable to that booking.

Company Values & Responsible Tourism

Hidden Gems AS is committed to creating authentic, respectful and sustainable outdoor experiences. We believe that nature should be experienced with care, humility and responsibility.

||Our guiding principles include: respect for nature and wildlife; respect for local communities and private property; small groups for a more personal experience; safety before reaching a destination; Leave No Trace principles; responsible photography; sustainable tourism practices; honest communication with our Guests; and continuous improvement of our services.

||Guests are expected to support these principles throughout every experience.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed exclusively by the laws of Norway.

||Any dispute arising out of or relating to these Terms or the services provided by Hidden Gems AS shall, unless otherwise required by mandatory law, be subject to the jurisdiction of the competent Norwegian courts.

||Before initiating legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through constructive dialogue.

Acceptance of Terms

By paying the Booking Confirmation Fee, confirming a booking in writing or participating in any service provided by Hidden Gems AS, the Guest confirms that they have:

• Read these Terms & Conditions in full.
• Understood their contents.
• Had the opportunity to ask questions before booking.
• Accepted these Terms voluntarily.
• Agreed to comply with all applicable policies referenced within these Terms.
